DMCA Policy

Streetsmartman takes intellectual property rights seriously. This policy explains how we handle claims of copyright infringement under the Digital Millennium Copyright Act (DMCA) and what steps you need to follow to raise a concern.

Overview

Streetsmartman ("we," "us," or "our") is committed to respecting the intellectual property of others. In line with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we have put in place the following policy for handling reports of alleged copyright infringement on our website.

If you have reason to believe that content on our website infringes your copyright, please follow the steps outlined in this policy to submit a formal DMCA takedown notice. All legitimate claims will be reviewed promptly and handled appropriately.

Designated Copyright Agent: All DMCA notices must be directed to our designated copyright agent at support@streetsmartman.shop with the subject line: "DMCA Takedown Notice."

Reporting Copyright Infringement

If you are a copyright owner — or someone authorized to act on behalf of one — and you believe content on our website infringes a work you hold rights to, you may submit a DMCA takedown notice to our designated agent.

To be valid under the DMCA, your notice must be a written submission containing all of the elements described in Section 3. Notices that are incomplete or inaccurate may not be actioned.

ℹ️ Before sending a DMCA notice, it's worth considering whether the use of the content in question may fall under fair use provisions. If you're uncertain, we recommend seeking legal advice before proceeding.

Required Elements of a DMCA Takedown Notice

For a DMCA takedown notice to be valid, your written submission must contain all of the following elements as required by 17 U.S.C. § 512(c)(3):

Your DMCA Notice Must Include:

  • A physical or electronic signature of the copyright owner or a person duly authorized to act on their behalf.
  • Clear identification of the copyrighted work alleged to have been infringed (or a representative list if multiple works are involved).
  • Identification of the infringing material along with sufficient information to locate it on our website — such as a specific URL.
  • Your contact details, including full name, mailing address, phone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or by law.
  • A statement confirming the accuracy of the information provided, and — under penalty of perjury — that you are authorized to act on behalf of the copyright owner.

⚠️ Incomplete notices will not be processed. All six elements listed above must be present for your notice to be considered valid and actionable under the DMCA.

Our Response to a Valid Notice

Once we receive a valid DMCA takedown notice, Streetsmartman will take the following steps:

Acknowledge Receipt

We'll confirm that we've received your notice within a reasonable timeframe, using the contact details you provided.

Review the Claim

We'll go through the notice to confirm all required elements are present and that the claim appears to have been made in good faith.

Remove or Disable Access

If the notice is valid, we'll promptly remove or disable access to the content identified as allegedly infringing.

Notify the Content Provider

Where applicable, we'll inform the party responsible for the content that it has been removed due to a DMCA claim, and advise them of their right to submit a counter-notification.

Counter-Notification

If you believe content removed from our site following a DMCA notice does not actually infringe any copyright — or that you hold the right to use it — you may file a counter-notification under 17 U.S.C. § 512(g).

A valid counter-notification must contain all of the following:

Your Counter-Notification Must Include:

  • Your physical or electronic signature.
  • Identification of the removed material and the location where it appeared on our site before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  • Your full name, address, phone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the district in which you are located (or, if outside the US, the district of the service provider).
  • A statement that you will accept service of process from the party who submitted the original takedown notice.

On receipt of a valid counter-notification, we'll forward it to the original complainant and may restore the removed content within 10–14 business days, unless the copyright owner initiates court proceedings.

Repeat Infringer Policy

Consistent with the DMCA and other applicable laws, Streetsmartman maintains a policy of terminating — where appropriate — the accounts or access of users who are found to be repeat infringers of copyright.

We reserve the right to refuse service, revoke access, or take other suitable action against any individual or entity that repeatedly disregards the intellectual property rights of others.

False or Misleading Claims

Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that content is infringing — or that material was removed in error — may be held liable for damages, including legal costs and attorneys' fees.

⚠️ All claims must be made in good faith. Filing a false or misleading DMCA notice is a serious legal matter with real consequences. If you're not certain whether the content constitutes infringement, please consult a lawyer before submitting a notice.

Our Own Intellectual Property Rights

All original content on the Streetsmartman website — including text, images, graphics, logos, product photography, page layouts, and design elements — is the exclusive property of Streetsmartman and is protected under applicable US and international copyright law.

Reproducing, distributing, displaying, or using our copyrighted content without prior written permission is strictly prohibited and may result in legal action. For licensing or permission enquiries, please contact us at support@streetsmartman.shop.

Changes to This Policy
